Gillan and Quinton v United Kingdom

Facts:

Mr Gillan and Ms Quinton lodged an appeal against the UK government claiming that the stop and search powers used against them where in violation of Articles 5 (right to liberty), 8 (right to a private and family life), 10 (right to freedom of expression) and 11 (freedom of assembly and of association) of the European Convention on Human Rights.

Mr Ahmet Öztekin (1st applicant) and Mr Celal Aygen (2nd applicant) brought an application against Turkey under Article 5 § 3 of the Convention. 

Grainger PLC v Nicholson

23rd December.

Nicholson brought an action against his former employer, claiming that his redundancy was due to discrimination over his philosophical beliefs about climate change

Zaunegger v Germany

21st December.

The applicant Horst Zaunegger complained under Article 14 (prohibition of discrimination) read in conjunction with Article 8 (right to respect for family life) that the reading a provision of the German Civil Code according to which children born out of wedlock were to be held under the sole custody the mother amounted to an unjustified discrimination against unmarried fathers on sexual grounds and in comparison with divorced fathers.

Lombardi Vallauri v Italy

14th November.

Mr Lombardi Vallauri’s rights under articles 10 and 6(1) of the Convention were breached by the Italian Government: the Catholic University of Milan should have justified its refusal to employ a lecturer who had not been approved by the Holy See. 

Chrapková v. Slovakia

12th November.

Ms Chrapková brought an application against Slovakia under Article 6 for the delay of her application for compensation following the transfer of agricultural property and livestock to a co-operative in 1951.

Adzigovich v Russia

30th October.

Relying on Article 1 of Protocol No. 1 (protection of property), Ms Adzhigovich complained that the Russian customs inspection authorities had confiscated and not returned money which she had not declared when travelling.

Kimlya and others v. Russia

29th October.

The claimants asserted the rights of Scientology organisations to exercise freedom of religion and association under the ECHR.

R. (on the application of L) v Secretary of State for Justice

29th October.

The Claimant attempted to commit suicide whilst in a Young Offenders Institute. He brought an application for judicial review on the basis that the State had breached its obligations under Article 2 ECHR
